Nicaragua: Anmeldt for å hjelpe niåring med abort - SAKEN ER AVSLUTTET

Den ni år gamle jenta Rosita fra Costa Rica fikk utført en lovlig abort i 2003, etter at hun hadde blitt utsatt for en voldtekt. Nå er ni kvinner tiltalt for å ha hjulpet til.

9 år gammel ble Rosita voldtatt av sin stefar og gjort gravid. Medlemmer av den nicaraguanske kvinnebevegelsen hjalp Rosita og hennes familie med å krysse grensen inn i Nicaragua, hvor hun kunne få utført en abort lovlig på den tiden.

I oktober 2007 gikk organisasjonen ANPDH, med støtte fra den romersk-katolske kirken til det skritt å anmelde ni av kvinnene.




OPPDATERING 18. juni 2010: Saken er avsluttet
Statsadvokaten har besluttet å avslutte etterforskningen av de ni kvinnene, og henlagt saken. Tusen takk til alle som sendte appeller, deres innsats nytter!

De ni arresterte kvinnene er:
Ana María Pizarro, Juanita Jiménez, Lorna Norori, Luisa Molina Arguello, Marta María Blandón, Martha Munguía, Mayra Sirias, Violeta Delgado og Yamileth Mejía. Alle er velkjente forkjempere for kvinners rettigheter i Nicaragua.

De jobber for forskjellige ikke-statlige organisasjoner og har betydelig kompetanse innen arbeidet med kvinners og barns rettigheter, og arbeidet med kvinner og barn som har vært utsatt for seksuelle overgrep og vold i hjemmet.

Dear Attorney General,

I would like to underline the importance of the role that women’s organizations have played in Nicaragua in improving access to more effective sexual health care services, raising awareness of sexual health issues and HIV/AIDS, combating domestic violence, working with survivors of sexual abuse and promoting women’s rights.

I would like to express my concern that the apparently baseless complaint against Ana María Pizarro, Juanita Jiménez, Lorna Norori, Luisa Molina Arguello, Marta María Blandón, Martha Munguía, Mayra Sirias, Violeta Delgado and Yamileth Mejía appears to remain open and ask the Public Prosecutor’s Office to either close the complaint or bring charges in accordance with international fair trials standards.

I also remind the authorities that they are obliged to recognise the legitimacy of the activities of human rights defenders and their right to carry out their activities without restrictions or fear of reprisals, as set out in the UN Declaration on the Right and Responsibility of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognised Human Rights and Fundamental Freedoms (UN Declaration on Human Rights Defenders).

This right is further recognised in treaties to which Nicaragua is a party, such as the International Convention on Civil and Political Rights (ICCPR), the International Convention on Economic, Social and Cultural Rights (ICCESCR) and the American Convention on Human Rights.
